Terms of Service

1. Acceptance of Terms

By accessing or using BrandBatch (the "Service"), operated by Commerce Consulting Services, SIA, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

BrandBatch is a web application for generating branded social media images, managing content templates, scheduling posts, and publishing to social media platforms. The Service includes image generation, template editing, content scheduling, and social media publishing features.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information during registration.

4. Subscription Plans

The Service offers the following plans:

• Free: 30 images per month, 1 custom template
• Pro: 300 images per month, unlimited custom templates
• Agency: Unlimited images, unlimited custom templates

Plan limits reset monthly. We reserve the right to modify plan features and pricing with 30 days' notice to existing users.

5. Your Content

You retain ownership of all content you create, upload, or generate using the Service, including templates, images, brand assets, and post copy. You grant us a limited license to store, process, and display your content solely for the purpose of providing the Service.

You are solely responsible for the content you create and publish through the Service. You must not use the Service to create or distribute content that is illegal, defamatory, or infringes on third-party rights.

6. Social Media Publishing

When you connect social media accounts and schedule posts, you authorize us to publish content to those platforms on your behalf at the times you specify. You are responsible for ensuring your content complies with each platform's terms of service and community guidelines.

We are not responsible for actions taken by social media platforms regarding your content, including removal, account suspension, or reach limitations.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Upload malicious files or attempt to compromise the Service
• Exceed your plan's usage limits through circumvention
• Resell or redistribute the Service without authorization
• Use automated tools to access the Service beyond intended functionality

8. Availability and Support

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance that temporarily affects availability. We provide support via email on a best-effort basis.

9. Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lost revenue, failed social media posts, or data loss.

10. Termination

You may terminate your account at any time. We may suspend or terminate your account for violation of these Terms. Upon termination, your data will be deleted within 30 days unless required by law to retain it.

11. Governing Law

These Terms are governed by the laws of the Republic of Latvia. Any disputes shall be resolved in the courts of Latvia.
